We are Marianna Lemos Design P.C. (‘We’ and ‘Us’ and ‘Marianna Lemos’). We have our registered seat in Athens (36 Voukourestiou, Athens 106 73, (VAT. No. 801658393).
What are the Terms & Conditions
By using this Site, whether as a registered user or a guest, you are agreeing to these Terms and Conditions.
Please read these Terms and Conditions carefully before you use this Site or buy anything through it. If you do not agree to these Terms and Conditions please stop using it immediately and do not buy anything through it. We may change these Terms and Conditions from time to time and will publish those changes on this Site.
Using this Site
You will need to register with us in order to purchase goods or services.
If you do not register with us we will allow you to use this Site (subject to these Terms and Conditions) but not to buy goods through it.
If you register with us we will allow you to use this Site and to buy goods through it but we may withdraw, restrict or change the service we provide through the site without notice.
The contract between you and us is legally binding. Your order constitutes an offer to us to buy a product subject to these Terms & Conditions. This does not affect your statutory rights. If we believe a customer acts against these Terms and Conditions, we reserve the right to cancel or suspend their order. This includes non-payment of ordered products and fraudulent use of our website and/or sales. We also reserve the right to bar certain e-mail addresses and telephone numbers from accessing our website to place orders. We will not accept an order from any customer who we have suspended. Ownership of the products will only pass to you when we have received full payment.
A person who is not party to the contract shall not have the rights under or in connection with it.
We may refuse to process a transaction or to provide a service at any time. We will not be liable to you or anyone else if we do this.
By ordering from our website, you agree not to commercially resell any of our products. Commercially reselling our products is a breach of these Terms and Conditions and your agreement with us.
Payment and Security
You may pay for the goods you buy from us by using Paypal or a debit or credit card through our online payment facility. We do not hold your credit or debit card data. You do not enter any card data into the Marianna Lemos Site. When you come to pay for your products you leave our site and your payment is processed through Viva Wallet secure server.
We accept Visa Credit and Debit, Mastercard, Maestro and American Express through Viva Wallet.
Our prices, as stated on the Site are in euro (€) and include VAT except where we say otherwise. You will be charged in euro even if you don’t live in the eurozone.
We reserve the right to alter prices at any time. Overseas orders may incur bank charges for international transactions.
Sending Goods to a Country Outside Greece
If you order goods from our Site for delivery outside Greece, they may be subject to import duties and taxes, which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note, we have no control over these charges and cannot predict their amount. Please contact the relevant customs and excise authorities for further information before placing your order.
Right to Withdrawal – Return of Products
Customers have the right to return the purchased products free of charge (and request an exchange or a refund), within fourteen (14) working days from the delivery date thereof. Customers shall only be charged for shipping costs. Please note that bespoke or customized products are non-refundable or exchangeable.
Returns of products are accepted under the following terms:
The item is returned in perfect condition, unworn with its packaging intact.
In case of a mistaken delivery, returns are accepted provided you notify us in writing within two (2) working days. In this case you will get a full refund of the value of the product and the shipping expenses.
If there was no mistake in the delivery on behalf of ‘Marianna Lemos’ only the value of the product shall be refunded, whereas customers shall bear the shipping costs.
Customers requesting a refund must provide ‘Marianna Lemos’ with a valid bank account number.
The payment receipt or invoice must be sent along with the returned products. In case of an invoice, the dispatch note must also be returned.
Customers who wish to return products to ‘Marianna Lemos’ must address an email to firstname.lastname@example.org within fourteen (14) working days from delivery under the title ‘Withdrawal request’. Said request must include the following information: date and number of order or the number of the dispatch note and the payment receipt or invoice. Please address this email prior to the shipping of the products you wish to return.
‘Marianna Lemos’ reserves the right to reject returns of products which do not comply with all the above terms. Please make sure to address a withdrawal and refund request only if products meet the above terms and the returned products are suitable for re-selling. The customer is solely responsible for the shipping of the retuned products, whereas ‘Marianna Lemos’ is unable to trace parcels in any courier/ shipping company.
For your convenience, please check the good state of the products and their packaging at the time of delivery, for obvious faults (e.g. broken products). Please notify us of any actual fault in the delivered products by contacting us immediately or during the next working day via phone at (+30) 210-3637858 (Monday to Friday from 10:00 to 16:00) or via email to email@example.com. The provisions of the Greek Civil Code apply with respect to actual faults and lack of agreed properties of the products.
‘Marianna Lemos’ shall refund customers for returned products within a period of thirty days from their receipt, with a deposit of their value to the bank account provided from the client.
Marianna Lemos jewellery is hand made to order. We aim to dispatch orders within 3 weeks from the date of order, so if you want to cancel without incurring a cost, you need to do it within one week of ordering. If you do want to cancel an order before dispatch you will need to call us on +30 210-3637858 during office hours, or via email to firstname.lastname@example.org
If you would like to change anything about an order we would recommend that, in the first instance you give us a call on +30 210-3637858 or email email@example.com to ensure changes can be made before the piece is finished.
Bespoke and made to order goods are non-returnable.
If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any other person. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these Terms & Conditions.
In order to find out more about our Website’s user experience, we retain and analyse the data we collect in an aggregated form through the use of trackers (cookies). For example, we may use this information in order to monitor and analyse the use and functionality of our Website, thise identifying its level of content engagement with the public, which in turn concluded the steps required towards securing its relevance with, and accessibility by, its visitors. We are the owner or the licensee of all intellectual property rights in this Site, and in the material published on it. The Site and the material on it is protected by copyright laws around the world and We reserve all our rights under those laws.
You must not use any part of the materials on our site for commercial purposes without first obtaining a license to do so from Us.
If We fail at any time to insist upon strict performance of any of your obligations under these Terms & Conditions, or if We fail to exercise any of the rights or remedies to which We are entitled under them, this does not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.
A waiver by Us of any default shall not constitute a waiver of any subsequent default.
No waiver by Us of any of these Terms & Conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing.
If any of these Terms & Conditions are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will, to that extent, be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
These Terms & Conditions and any document expressly referred to in them represent the entire agreement between Us and supersede any prior agreement, understanding or arrangement between Us, whether oral or in writing.
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control. This includes, without limitation, acts of God, governmental actions, war or national emergency, riot, invasion, terrorist attack or threat of terrorist attack, civil commotion, fire, explosion, storm, flood, epidemic, or other national disaster, lockouts, strikes or other labour disputes, or restraints or delays affecting carriers, impossibility of the use of public or private telecommunications networks
Law and Jurisdiction
Contracts for the purchase of goods through our Site will be governed by the laws of Greece. Any dispute arising from, or related to such Contracts shall be subject to the non-exclusive jurisdiction of the courts of Greece.
